IS YOUR MARK A REGISTRABLE TRADE MARK?

A trade mark is a sign that is used to distinguish goods or services provided in the course of trade.  The Trade Marks Act 1995 recognises any or a combination of the following qualifies as a sign: any letter, word, name, signature, numeral, device, brand, heading, label, ticket, aspect of packaging, shape, colour, sound or scent. 

With use your mark becomes valuable as it identifies you and your goods and services in the mind of the consumer.  If you have built a reputation in any of the abovementioned signs that distinguishes your goods or services from those provided by others, it will be worthwhile considering protecting the mark for your exclusive use and prevent competitors from using it to capture your potential customers or diluting the standards or qualities associated with your goods and services.
