By January 17, 2023January 16th, 2024Branding, IP Insights

With the New Year now here, it is time to think about a refreshed brand and image. When was the last time your business branding was updated? The New Year is a perfect time to consider refreshing your Brand.

Before you do, we recommend that you consider the following:

  1. Will the refreshed branding include a new word trade mark, a re-stylised word trade mark, a new image, new colour scheme or graphics, new packaging?
  2. Does the new branding align with my company’s marketing focus?
  3. Does the new branding set me apart from my competitors?
  4. Do I need to seek trade mark protection for my new branding?

We recently sent out correspondence for refreshing your brand and image. But what is the importance of refreshing your brand?

Refreshing your brand shows your existing clientele that you are a dynamic and upwardly trending business. Modernising or revitalising your brand can also assist in reaching a broader demographic. This is particularly helpful when your business or industry has recently begun to shift in a new direction. In addition, an outdated brand may not be flexible enough to reproduce well in all use cases.

Not to be mistaken for “rebranding”, refreshing the brand means keeping the essence of the brand to retain the “link” but adding or changing other elements to give it an updated look. Other elements include a graphic or device; a tag line; colours, fonts and style; and one or more word element changes. These elements are not just important to the aesthetics of your brand, but can impact the protection of your existing trade mark.

Reviewing your trade mark is imperative when refreshing your brand

When reviewing your trade mark, the question that you ask yourself is “What is the essence of the current trade mark?” and “What parts provide the memorable components of the brand?”.

After identifying the essence of your brand, ask yourself “Where are we going?” and “Who are we now?”. Then consider how your trade mark can be changed to reflect who we are now and where are we going.

With a refreshed brand it is prudent to seek the advice of your attorney at Wynnes Patent and Trade Mark Attorneys to determine whether protection should or needs to be obtained. Trade mark registration protects the brand throughout all of Australia and captures the goodwill in the business hence increasing the value of the business.
