UK Trade Mark Use Requirements from 1 January 2026

As part of the ongoing transition following Brexit, please be aware that from 1 January 2026, use of a trade mark in the EU will no longer be considered valid use in the UK.

This means that if your UK trade mark has only been used in the EU, it could become vulnerable to a non-use removal action unless there is also genuine use in the UK.

To maintain and protect your rights, it is important to ensure that your mark is being used in the UK in connection with the relevant goods or services.
